DERLING’s partner Piret Blankin successfully represented the Political Party Funding Supervision Committee in high-profile election advertising matters

On 21 November 2016, the Supreme Court closed disputes between the Political Party Funding Supervision Committee and Karin Tammemägi and Priit Kutser, who had used the funds of the City of Tallinn during their election campaign in 2013. All court instances agreed with the Committee in that the publicly displayed posters concerned constituted a prohibited donation within the meaning of the Political Parties Act. Karin Tammemägi and Priit Kutser, as well as Edgar Savisaar and Jaanus Mutli, who were involved in similar disputes, will have to return such donations to the City of Tallinn. The court proceedings also highlighted a number of shortcomings in the Political Parties Act, which will need a makeover in the light of the recent judgments.
